1. Arbitration Provisions

Informal Dispute Resolution
Prior to resorting to formal legal proceedings, we endeavor to resolve disputes amicably. It is mutually agreed that before escalating any dispute or claim to arbitration, both parties will engage in a sincere attempt to resolve it informally. This involves at least one telephone or videoconference discussion between you and us. To initiate this informal resolution process, you are required to notify us in writing at El Rodeo Western Boutique, 2295 S Military Trl, West Palm Beach, FL 33415, Attn: Legal Department. In your notification, specify the nature of the dispute, the basis of your claims, the sought-after resolution (including any monetary aspects), and provide detailed information for a comprehensive understanding of the issue. Within sixty (60) days of receiving this notice, both parties commit to making genuine efforts to resolve the dispute, including personal participation in a telephone call or videoconference. 

Any agreement resulting from this informal discussion shall remain confidential. You may have legal representation during this call if desired. Failure to resolve the dispute within the stipulated sixty (60) days (extendable by mutual agreement) may lead to the commencement of arbitration as per the outlined procedure. Completion of this informal dispute resolution process is a prerequisite for initiating arbitration. Both parties agree to suspend any relevant statute of limitations and filing fee deadlines during this informal resolution period, provided you adhere to the Terms. A competent court holds the authority to enforce this prerequisite to arbitration, including potentially halting the arbitration demand. Any claim related to this Website, including product purchases, must be initiated within one (1) year of the claim's occurrence.
Arbitration Agreement & Waiver of Rights
You and we agree to settle any disputes, claims, or counterclaims through binding and final arbitration, as per the Consumer Arbitration Rules of the American Arbitration Association (AAA). This means we won't resolve matters in court. This arbitration agreement applies to any claims you haven't already filed in court before agreeing to these terms. You can access the AAA Rules at www.adr.org or by calling 1-800-778-7879. Both parties waive the right to a jury trial. 

A single arbitrator will handle the arbitration, and their decision is final and enforceable in any competent court. The arbitration process must remain confidential, with no details disclosed outside the proceedings unless required by law or allowed by state law. The Federal Arbitration Act and related laws govern these terms. The arbitrator has the exclusive authority to interpret and enforce these terms, including any disputes about their validity.

To start an arbitration, send a signed letter describing your claim to El Rodeo Western Boutique, 2295 S Military Trl, West Palm Beach, FL 33415, Attn: Legal Department, at least ten days before starting arbitration. Offers to settle can be made in writing more than ten days before arbitration, following California Code of Civil Procedure section 998.

If you prove arbitration costs are too high compared to litigation, we'll cover enough administrative and arbitrator fees to prevent excessive costs. The arbitrator can decide how to split these costs at the end. This agreement doesn't stop either party from seeking action from government agencies or taking qualifying claims to small claims court. Requests for provisional relief can also be made in court without waiving the arbitration rights.

Neither party can act as a class representative or join a class action in arbitration. Claims must be brought individually, and the arbitrator can only address your or our claims without joining others. The arbitrator can award the same damages or relief available in court, excluding public injunctions, which can only be awarded by a court.
Mass Arbitration Process
If 25 or more similar claims are filed against El Rodeo Western Boutique by the same or coordinated counsel, your claim resolution may be delayed. Initially, 20 claims will proceed to arbitration, split equally between selections by claimants and El Rodeo Western Boutique. Remaining claims will wait for their turn, with no AAA fees until they proceed. If unresolved, parties will mediate with a retired judge, with El Rodeo Western Boutique covering the mediator's fee. If mediation fails, 40 more claims proceed, selected similarly. This continues, with up to 100 claims at a time, until resolved.

At any point, parties may enter global mediation if requested. Statutes of limitations and filing deadlines pause during this mass process. A court can enforce these mass arbitration rules. If unenforceable, both parties will work with a Process Arbitrator to find efficient solutions. Parties can also work with the AAA to reduce arbitration fees. If any part of this Section is invalid, the rest remains effective. Waivers must be in writing and don’t affect other terms. This Section survives the end of your relationship with us.

Cancellations and Modifications
If you need to modify your order, please reach out to customer service promptly. Orders are typically final once placed, so you may need to return items post-delivery if changes are necessary. (Follow our returns policy) In case an item is no longer available after your order is placed, you will either not be charged for that item or receive a credit for it.
Product Information, Pricing, and Inaccuracies
The prices shown on our websites may vary from those in store and can differ between different location. All prices listed on the websites are in U.S. dollars, unless stated otherwise. For items on sale, the original price will be displayed with a strikethrough, and the sale price will be shown next to it.

Clearance items will be marked accordingly, potentially using a third-party content delivery application, next to the product details. Once items are marked for clearance, their prices will not be reverted to their original prices or increased. Occasionally, sales prices and discounts may be combined.

Clearance items are considered final sale, and as such, specific guidelines govern such transactions. Returns of these products are not permitted. Should an issue arise where the product requires a size exchange and the desired size is unavailable, the customer will receive store credit following the return and inspection of the item. This credit must be utilized within 45 days. It is imperative to adhere to the Exchange policy outlined in the returns and exchanges section to determine eligibility for any potential exchanges.

While we strive to accurately represent product colors, the colors you see may vary depending on your monitor's settings. Periodically, there may be errors, inaccuracies, or omissions in product descriptions, pricing, or availability information on our websites. We reserve the right to rectify any errors, inaccuracies, or omissions and update information without prior notice, even after you have placed an order. If you wish to cancel or return your order due to corrected pricing or information, please contact us promptly, and we will assist you accordingly.
